EXPLANATORY NOTE
This bill seeks to solve conflicts between MMDA and the PNP Traffic Management with regards to implementation of ticketing amongst traffic violators. It does solve confusement with the driver who has been ticketed and those tickets where not honored by other ticketing officers, thus making the violators ticket double. It also protects drivers from abusive ticketing officers. This bill clearly holds the responsibility of Philippine National Police traffic management of ensuring traffic regulation in Metro Manila roads and streets only.
An act enforcing the Philippine National Police and vesting in its primary responsibility of implementing traffic rules and regulations as well as other matters related to the orderliness of the roads and strict implementation of traffic rules and regulations.
SEC. I – The PNP traffic management shall be primarily responsible for the enforcement of traffic rules and regulations as promulgated by the Metro Manila Development Authority (MMDA) to ensure the safety of Metro Manila roads and streets and to protect the rights of the motorists against multi ticketing because of lacking laws in regards with this.
The MMDA shall be the road traffic administrator tasked with the duty of issuing rules and regulations and standards pertaining to road safety and security while the PNP traffic management shall be tasked as enforcers of this laws as promulgated by the MMDA.
SEC. II – The PNP Traffic management shall have here its functions in addition to those already granted by existing laws and not conflicting with this act.
A. To enforce laws and regulations issued by the MMDA
B. To cooperate with the Land Transportation Office (LTO) to intensify driver licensure test to filter those who are really qualified to become a driver.
C. To conduct thorough investigation among drivers who committed traffic violation.
D. To prevent incompetent vehicles to travel on roads and streets of Metro Manila. The ff. are traits of vehicles which are not allowed to travel.
- Vehicles with dilapidated chassis.
- Vehicles with mufflers that contributes to noise pollution.
E. To respond in any vehicular accidents that occurred.
F. To organize training programs for officers that will be deployed on duty.
G. To verify legal documents and requirements of a vehicle to travel,
- License of the driver
- Registration of the vehicle
- Smoke belching clearance
- Franchise certificate (if a public utility vehicle)
- Plate number verification
H. If public utility vehicle, verification of compliance with the LTFRB requires
- Route of the vehicle
- Fare matrix
- Requirement in uniform (if necessary)
I. to enforce orders of MMDA particularly suspension of franchise of the vehicle, drivers license and other concerned topics about violation/s of the vehicle.
J. To follow due process in issuing tickets to the violators.
K. To submit monthly report to the chair of MMDA and the head of PNP traffic management regarding traffic developments, suggestions and comments to enforce traffic laws more effectively.
L. To designate vehicular traffic separation scheme and/or system appropriate.
SEC. III – Fines will be properly implemented by the PNP in accordance to the laws promulgated by MMDA.
SEC. IV – Revenue derived from the fines will be properly receipted, recorded and remitted to the bureau of treasury in accordance with existing rules of the Department of Budget.
SEC. V – The PNP traffic management can also promulgate laws but only w8ith accordance to the laws enacted by the MMDA.
SEC VI – In cases of accidents resulting to loss and permanent damage to lives, drivers, conductors and operators shall be dealt with criminal and civil liabilities in accordance with existing criminal and civil laws.
SEC VII – Any liable person convicted by court guilty for damage to lives shall be compelled to fine not less than fifty thousand pesos and not more than three hundred thousand pesos and/or suspension of drivers license and vehicles franchise.
In cases of loss of lives, the convicted party shall be compelled to fine not less than nine hundred fifty thousand pesos but not more than three million pesos according to number of lives lost.
SEC VIII – If approved, any executive order, city ordinance, provision of other bill with conflicting ideas shall be repealed or modified accordingly.
SEC IX – the MMDA shall remain as traffic administrator even if MMDA is transferred or combined with another department of government, but if dissolved, the power to promulgate, enact and make traffic rules and regulation shall automatically be transferred to city councils and PNP traffic management remains the traffic enforcers.
SEC. X – This act shall be implemented fifteen days after publication on the Official gazette.
will it really be possible that the MMDA subside under the authority of the PNP? And if the PNP will just enforce the rules created by the MMDA, then why not let MMDA take sole responsibility and control to enforce their own rules?
So what if PNP will hold the implementation of traffic rules?? whether the PNP and MMDA will hold the responsibility of the violators in traffic rules, etc., how can you be sure that it would lessen the violators?? la lang, kahit sinu pang magpatupad nian e ganun pa rin, mas mahaba pa ang proseso.
I think we should clearly define the responsibilities of both institutions.

so youre saying that the pnp will act in accordance with the mmda? i mean they undergone tedious trainings just to become traffic enforcers?
