AN ACT REFERRING TO SOME OF THE FARM LOTS WITHIN THE PHILIPPINES THAT HAVE BEEN USED FOR BIO-FUEL GAS BE CONVERTED AS A FIELD FOR PLANTING RICE
Be it enacted and assembled:
CHAPTER 1
OBJECTIVES, POLICIES AND COVERAGE
Section 1. Short Title- This act shall be known as “The conversion to a field of Planting Rice Act of 2008”
Section 2. Objectives- The conversion aims to improve the use of land in its most suitable and most efficient use of allocation for agricultural and environmental purposes
Specifically focuses to:
(a) Have an efficient production of rice in order to ensure adequate supply of the most and needed commodity of every people, furthermore, to make its supply extendedly available and more accessible for other counties to consume and as for our country, this to be an asset and financial earnings.
(b) Provide a dominant solution for a rice shortage and common problem of rice crisis
(c) Allocate rice crops to its most efficient place to be planted and growth, also, to relocate those for bio-fuel gas into the land that was not yet been used, idle lands, disposable or reserved lands by the government.
(d) Minimize the direct competition with the land use for food production and a environmental strategy to decrease air pollution.
(e) Generate employment opportunities and provide extra/additional income to the country and rural communities
Section 3. Declaration of Policies- It is the declared policy of the state to protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature. Likewise, the improvement of the quality of our environment (natural resources and agricultural sources) should occupy a higher place in the scheme of priorities of the government to advance the quality of life of the people and ensure the stability in the nation.
Section 4. Coverage- At least 40% of overall land that was used for bio-fuel gas in Luzon, Visayas and Mindanao which totals into a million of hectares. Specifically targeting the areas with a near irrigation, rich soil and a large number of communities, to be a perfect allotted place for conversion to plant rice.
Section 5. Definition of terms- As mentioned in this Act, the following terms will mean:
(a) “Bio-Fuel gas” refers to the fuel gases that were from the conversion of such plants into an alcohol and tends to replace gasoline and diesel used for engines.
(b) “Efficient Production” refers to the stable and rich supply of products in nation relatively competes with the production abroad.
(c) “Healthful Ecology” refers to the stable interrelationships of living things and their environment.
(d) “Stability in Nation” refers to the efficient condition of the nation to produce a particular product and provide an efficient/high amount of financial earnings.
CHAPTER II
EFFECTIVE IMPLEMENTATION
Section 6. Program Implementing of Agencies and Institutions- The following shall perform major and important roles:
(a) The Department of Agrarian Reform (DAR) - shall provide assistance to the benefits of the project, financial help for conversion and upland development is part of Agrarian Reform Fund. It shall provide plans, implementation, coordination and monitoring consistency, particularly responsible for the selection and allocation of sites, as well as the protection for plantations. It shall also provide data to the Local Government Units (LGUs) and development plans of concerned LGUs.
(b) The Department of Agriculture (DA) – shall provide workers and farmers the proper agricultural techniques and practices, including the strategies and proper guide. The production, promotion and distribution of quality planting materials were part of the Agricultural Competitiveness Enhancement Fund (ACEF).
(c) The Department of Environment and Natural Resources (DENR) – shall provide and initiate support for the implementation of this act as well as for controlling, supervising the exploration, development, utilization and maintaining stable management for conservation of the country’s natural resources, that will be highly serve as the factors during and after the conversion.
Section 7. Role of Local Government Units (LGUs) - shall provide support for the cultivation of land and for the conversion of crops. The LGUs shall ensure close coordination with the DAR and DENR to initiate necessary extension service and information. As mandated under the Local Government 1 Code, the LGUs shall be responsible in the distribution of seedlings or planting materials and the establishment and development of modern environmental studies as part of their extension services in their respective constituencies.
Section 8. Role of Nongovernmental Organizations (NGOs) – shall be tapped to handle relevant services, social and technical training.
CHAPTER III
RIGHTS AND OBLIGATIONS
Section 9. Rights- it shall be equally distributed to all specifically involve in this Act.
(a) The farmers have the rights to gain salary for planting rice and shall be benefited from the product. The farmers should not pay for the use of land.
(b) Agencies such as DENR, DAR, DA and LGUs have the rights to intervene for the progressive interest of the lands and crops and shall decide for the allocation of the respective budgets sufficient funds to supply the needs of the project.
(c) DBM and other banks have the rights to coordinate with the agencies regarding the release of the funds.
(d) The Right to export of the product that will be harvested.
(e) The citizens of this country shall be benefited first of the product at the much lower price.
Section 10. Obligations- it shall be strengthened, followed and be implemented with the agreement of the law.
(a) The farmers have the obligation to maintain the progress of the crops, to work for the benefits of the product, to harvest and fully participate to the regular coordination or meetings with the staffs and officials of the agencies regarding new and modern information and process for the use of land.
(b) Agencies such as DENR, DAR, DA and LGUs have an obligation to properly manage and seek for the improvement of the project and shall be responsible for any mislead, inaccuracy, misunderstanding and trouble upon processing.
(c) DBM and other banks have an obligation to manage and provide the funds that have been requested to release.
(d) The government shall provide less price of the rice to the country and for the consumptions of the citizens.
CHAPTER IV
FINANCING THE CONVERSION
Section 11. Conversion Funding- In relation with funds, under an act, this conversion shall be financed primarily from any available Official Development Assistance (ODA) including, but not limited to,
(a) Private Sector Investment for the plantation of rice
(b) Project investment by LGUs and Cooperatives
(c) Project proposal approved by the DAR and DENR by an individual
Section12. Fund Management- The funds shall be manage by the Department of Budget and Management (DBM) and channeled it through the Land Bank of the Philippines (LBP), Development Bank of the Philippines (DBP) or Accredited Rural Banks.
Funding shall be discontinued if the allocated funds are either suspect or found misused or specific schedule of activities are not followed.
The DAR and DENR shall have an coordination with DBP and other banks and shall advice on the amount of release and the period of release of funds.
CHAPTER V
OFFENSE AND PENALTIES
Section 13. Misuse of Funds- Any person who shall unlawfully and intentionally divert the funds under this act for purposes other that intended shall be criminally prosecuted and if prove guilty, shall be punished with imprisonment of not less than 10 months but not more than 10 years.
Section 14. Prohibited Acts and Penalties
(a) Any person who will intentionally or unintentionally damaged or totally destroyed the allotted areas and crops shall be fined twice the total amount of the whole land to which it was damaged or destroyed and/or imprisoned for a period of not less than 5 months and seven days to 2 years.
(b) Any person who will use the allocated lands without any permit and with a personal interest, gain or profit shall be fined thrice the total amount of the whole land that was been used and imprisoned for a period of not less than 11 months to 8 years.
Provided that the maximum penalty shall be imposed upon the offender who repeats the same offense and double the maximum of the penalty upon the offender who commits the same offense for the third time.
(c) Any person who will commit illegal occupancy of the land, the court of competent jurisdiction shall further order the eviction of the offender from the land and the forfeiture to the government of all improvements made. In case the offender is a government official or employee, he shall, in addition to the above penalties be automatically dismissed from the office and permanently disqualified from holding any elective or appointive position.
CHAPTER VI
ADMINISTRATIVE ACTS, PROCEDURES AND SPECIAL CLAUSES
Section 15. Promulgation of Rules and Regulations- The Secretary of the DAR and DENR, in coordination with the secretaries and heads of the mentioned agencies, shall prepare and provide rules and regulations implementing this Act within ninety (90) days from the date of its effectivity.
Section 16. Seperability Clause- If any provision 1 of this Act shall be held unconstitutional, the remaining portions not otherwise affected shall remain in full force and effect.
Section 17. Repealing Clause- All laws, executive orders, rules and regulations or parts thereof inconsistent with any of the provisions of this Act are hereby amended repealed or modified accordingly.
Section 18. Effectivity- This Act shall take effect after its complete publications in at least five (5) newspapers of general circulation.

the problem i think is not the conversion of this farm lands to biolfuel lands, the problem is that this farm lands are not cultivated due to lack of irrigation, etc…

i do recognize the essence of the bill as i think that we have really problem with regards to the rice crises which is not only local aspired but globally known. the point maybe of the author is to promote a high probability of stabilizing somehow our rice supply hence it could also tend to mitigate some social disturbace, hence there is a strong correlation between crimes and hunger. but the author as i think again should justify how would this provision would really promote better economy for juan delacruz, how would rice should be recognize with the biodiesel, a promise of energy that could sustain not only our industry but also transportation and merely the environment with less phyo-pollutants compared to the present oil that is used to run same aspect’.

I think the lands converted for biofuel are not that big to merit reconversion…
so deep.. d ko pa masyado maabsorb.. pero bkit biofuel lands..
4o% ng hectares ng lupa ng Pilipinas, bakit million hectares….sobrang laki nun… di ko lang talaga makita ung logic na bakit sa mga taniman ng bio-fuel plants pa ilagay ung sa rice..wherein pede naman maghanap ng lupa na pagtataniman ng rice, sabi mo nga million of hectares meron ang Pilipinas, eh di ba….

The conversion is not actually setting aside the importance of biofuel gas, but making a better plan to produce it efficiently. The bill also for the prevalent of jatropha plantation (Considering that, jatropha plants will not compete for food production and process producing fuels using it will definitely minimize pollution and doesn’t demand healthy soil. Probably, producing fuels using such vegetation crops create pollution and as an author of the Bill for Environment and Natural Resources, I’am to make a fine solution for that, such other terms, objectives and proposals will be the guts of this bill). As stated, the lands that will be converted will be the vegetation and so, jatropha plants will not be included. This bill also doesn’t create another problem into our country but more of creating new strategy for an improvement in the economy and promoting the production of fuel with the use of jatropha plants, thus, such negativism will be as usual as it is.
I intentionally did, not to named nor to include the specific places of the lands that will be converted as well as the lands planted with crops for bio-fuel. As stated there, the land that will be choosed should have the fit qualities and should undergo further observation, under the decision and management of DENR and DAR. Perhaps, I have considered that the specification of lands, was not that needed and since it will be under the supervision of the two department, specifying the list of lands planted with crops for bio-fuel and choosen lands for conversion, will be their responsibility and jurisdiction.
It’s true that there will be a decrease on the production of fuels in the country temporarily, perhaps, the bill of Mr. John Henry Tamayo will be my sample of propose solution for that (it was really a coincidence for him to have that good idea, thus, it will be also my idea for the government to totally prevent those dilapidated vehicles, both public and private.It will however, help minimize the consumption of fuels and helpful for the safetiness of the people.
The question of why of does unused lands in the country, the land of vegetation that used to produce bio-fuel gas have been choosen to convert into a field for planting rice. First, the location and the quality of soil of those lands where the vegetation for bio-fuel gas, were planted, was merely needed by the rice plants. Secondly, the plantation of rice seeks a quality of soil and doesn’t fit with any of just unused lands in the country, while plants for bio-fuel gas do (Meaning, those plants doesn’t urgently need a quality of soil and right irrigation unlike the field of rice, for them to grow qualitatively). Third, as a citizen of the country, we first and foremost solve problems one at a time (for its effectiveness), consider propose solutions, look for its assets, also, learn to analyze ideas and proposals, in terms of changes, people needs and hunger, and spend for the benefit of the people, with a unite aim and proper ethics.
